Cost-Effective Commercial Litigation

Cost effective commercial litigation requires two things: an experienced lawyer (charging reasonable fees) and a good plan.

Experience: Over the past thirty years, as a New York commercial litigation lawyer I have successfully handled many cases including contract disputes, enforcement of restrictive covenants in employment disputes, disputes over partnership agreements, trust and will disputes, and business valuations.  I generally do most of the work and do not usually use assistants running up hourly charges.  Nevertheless, I have successfully handled many cases where major New York City law firms represented the opposition. (E.g. Levitt v. JP Morgan Chase, class certification granted where the opposition was represented by the law firm of Arnold & Porter). Keeping staffing to a minimum not only saves money for you but often improves the result because transferred information from an associate to a partner can mean lost information.

Developing a Plan: A good plan looks strategically at a case and sets goals.  This involves examining the strength of the claim or defense, availability of evidence, sources and expenses in obtaining such evidence, settlement options, and the anticipated cost of litigation.  This plan is developed by thoroughly discussing the case with you at the outset.  Like any game plan, the plan will evolve as the case progresses, but having a plan allows developments to be evaluated in the context of the overall goals.

As a client, you will tend to be most satisfied when the case is initially evaluated on three factors: likely financial result at trial, cost to obtain this result, and acceptable settlement.  Of course, the position of the other side will influence both the cost and the possibility of settlement, but if these items are discussed and reasonably estimated, you will be better able to evaluate options which develop during the course of litigation.  Examples of cost considerations include: is a witness necessary? Is this person likely to have significant information for either side? If not, there is little point in incurring the expense of taking that witness deposition.  Is an expert necessary and what is the anticipated expense for such expert? 

While ultimately most cases settle, often a decent settlement cannot be achieved unless you are prepared to go to trial and the other side recognizes this.
