I represent many investors who have lost money as a result of improper activities by a broker. These cases include both stocks and bonds. Today, most cases on behalf of individual investors are required to be arbitrated. Brokers can be held responsible for such things as recommendations of unsuitable securities such as speculative stocks for a conservative investor, too frequent trading (called churning), or failure to investigate the security underlying a bond. They can also be held liable for misrepresentations, including failing to disclose material facts relating to the security which they knew or reasonably should have known.
I am also representing the lead plaintiffs in a case against the former Bear Stearns, now taken over by JP Morgan Chase. My clients became lead plaintiffs after a settlement negotiated by Milberg Weiss on behalf of other lead plaintiffs was overturned by the Court because the settlement was too low. Frequently, class settlements are made which only result in pennies on the dollar to the investor. I believe that where the facts are strong, and the defendants have sufficient resources, there is no reason to settle for amounts which will not be significant to the plaintiff investors.
Because so many of the cases are required to be arbitrated, it is helpful to have a lawyer who understands how arbitration works and the evidence through subpoena which can be obtained. Many critical facts are not known to investors but were known to the broker or others related to the broker. The only way of obtaining these facts is through the use of subpoenas.
